Complex Cases - Swedish Citizenship


Below is an excerpt of some of the most complex or interesting citizenship cases successfully handled by our citizenship expert, Adam M. Lindström (and one case that could not be resolved):

  • The Man with One Name

    A man applies for citizenship, but the matter is complicated by the fact that his passport and residence permit decision only list a single name, no surname. Swedish authorities are not always accustomed to these situations, which meant the man could not register for BankID, apply for citizenship (his application was halted for further investigation), or perform certain other actions with authorities.

    Solution:

    • Application for an additional name with the Swedish Tax Agency, a statement was submitted to the Migration Agency's citizenship unit, and within two months, the man was granted Swedish citizenship. Congratulations, my friend!

  • Not Residing in Sweden

    A man from a non-EU country wants to become a Swedish citizen as his spouse is Swedish, and their adult children live in Sweden. The problem? He and his spouse do not reside in Sweden, and he lacks a residence permit.

    Solution:

    • Citizenship application accompanied by a statement on exemption provisions found in case law and propositions (applicant residing together in a country where neither is a citizen for a sufficient period, sufficiently long marriage, sufficient connection to Sweden, and a demonstrated need). He was a Swedish citizen a couple of months later! 

  • The Security Case

    A person applies for citizenship, but the case is investigated as a security matter, and SÄPO (Swedish Security Police) recommends rejection, leading to the Migration Agency denying the application.

    In these cases, since some time ago, the decision can only be appealed to the government and requires exceptional grounds. The challenge is that SÄPO, for security reasons, does not specify why they recommend rejection, making an appeal a shot in the dark. In exceptional cases, it's possible to request a personal interview with SÄPO to explain oneself, but this rarely leads to a change in their stance.

    In this case, SÄPO refused a personal interview, declined to provide details, and the appeal was not taken up for processing.

Did you know that if you have become a Swedish citizen through application (naturalization), your citizenship can never be revoked by law! For now, but the Citizenship Act is under review, so stay updated!
